Terms and Conditions

Welcome to Azure Lens Studios. These terms and conditions outline the rules and regulations for the use of Azure Lens Studios' services, located at 500 Union Street, Suite 800, Seattle, WA 98101. By accessing this website and using our services, you accept these terms and conditions in full. If you disagree with these terms and conditions or any part of these terms and conditions, you must not use our website or services.

2. Booking and Payment

All bookings are subject to availability and require a non-refundable deposit to secure the date and time. The deposit amount will be specified in the Contract. The remaining balance is due as specified in the Contract, typically either before the photoshoot or immediately upon receipt of the final Images. We accept payments via credit card, debit card, bank transfer, and cash (in person only). Late payments may incur a late fee of 5% of the outstanding balance per week.

3. Cancellation and Postponement

If the Client cancels the Services, the deposit will be forfeited. If the Studio cancels due to unforeseen circumstances (e.g., illness, equipment failure), the Client will receive a full refund of all payments made, or the option to reschedule the Services at no additional cost, subject to availability. Postponement by the Client is subject to the Studio's availability and may incur additional fees. Notice of postponement must be given at least 72 hours prior to the scheduled photoshoot.

4. Copyright and Usage Rights

The copyright of all Images remains with Azure Lens Studios. The Client is granted a personal, non-commercial license to use the Images for personal use, including printing and sharing on social media. Commercial use of the Images requires prior written consent from the Studio and may be subject to additional fees. The Studio reserves the right to use the Images for promotional purposes, including but not limited to website display, social media marketing, and portfolio presentation. Clients wishing to restrict such usage must notify the Studio in writing prior to the photoshoot.

5. Image Delivery and Storage

Final Images will be delivered in digital format via a secure online gallery within the timeframe specified in the Contract. The Studio is not responsible for the long-term storage of Images. Clients are advised to download and back up their Images promptly upon delivery. We maintain a backup of your images for 3 months. After this period, we cannot guarantee availability.

6. Client Responsibilities

The Client is responsible for obtaining all necessary permissions and consents for the photoshoot, including but not limited to location permits and model releases. The Client is also responsible for the conduct of themselves and their guests during the photoshoot. The Studio reserves the right to terminate the photoshoot if the Client or their guests engage in inappropriate or disruptive behavior. The Client must also inform the studio regarding any relevant allergies or medical conditions ahead of the photoshoot.

7. Liability

The Studio is not liable for any loss or damage to the Client's property during the photoshoot. While we take all reasonable precautions, the Studio is not responsible for any injury sustained by the Client or their guests during the photoshoot, unless caused by gross negligence on the part of the Studio. Our maximum liability to you is limited to the amount you have paid to Azure Lens Studios.

8. Editing and Retouching

The Studio provides standard editing and retouching services as part of the Services, including color correction, exposure adjustments, and minor blemish removal. Additional retouching services, such as extensive skin smoothing, body reshaping, or object removal, may be available for an additional fee. The Client will have the opportunity to review and approve the final edits before delivery.

9. Travel Expenses

For photoshoots outside of the Seattle metropolitan area, the Client is responsible for covering the Studio's travel expenses, including mileage, accommodation, and meals. Travel expenses will be outlined in the Contract.

10. Model Release

Unless otherwise agreed upon in writing, the Client grants the Studio the right to use the Images for promotional purposes, including but not limited to website display, social media marketing, and portfolio presentation. If the Client does not wish for the Images to be used in this manner, they must notify the Studio in writing prior to the photoshoot. A separate model release form may be required for individuals appearing in the Images.

11. Force Majeure

Neither party shall be liable for any failure to perform its obligations under the Contract if such failure is caused by circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, natural disasters, or government regulations. In such cases, the affected party shall promptly notify the other party and make reasonable efforts to mitigate the impact of the force majeure event.

12. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles. Any disputes arising out of or relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of King County, Washington.

13. Amendments

The Studio reserves the right to amend these terms and conditions at any time. Any changes will be posted on the Studio's website and will be effective immediately upon posting. It is the Client's responsibility to review these terms and conditions periodically for any updates.

Our website may contain links to third-party websites that are not owned or controlled by Azure Lens Studios. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. By using our website, you expressly relieve Azure Lens Studios from any and all liability arising from your use of any third-party website.

16. Severability

If any provision of these terms and conditions is found to be invalid or unenforceable under any applicable law, such provision shall be struck from these terms and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These terms and conditions, together with the Contract, constitute the entire agreement between the Client and Azure Lens Studios relating to the Services, and supersede all prior agreements and understandings, whether written or oral.
